What Is Mediation?
In South Carolina, Mediation is designed to offer you and your soon-to-be-ex-spouse the opportunity to reach an agreement on outstanding issues instead of allowing a judge to make those decisions. A mediator is an independent, neutral facilitator who will help you arrive at an amenable arrangement. For many, this can be a more cost-effective, less-stressful way to end your marriage through communication and agreement, all facilitated by the mediator, avoiding a long, drawn-out court battle.

How does Mediation work?
If you are ordered to mediation, your responsibility is to participate and attempt in good faith to reach an agreement. By participating in mediation, you do not give up any rights, and you are not forced to agree to anything. It is the role of the mediator to help you and your soon-to-be ex-spouse to reach an agreement, not make the decision for you. Mediation is a confidential process, and anything you say during mediation cannot later be used against you in a court proceeding. Finally, mediation does not have to be all-inclusive. You may only be able to resolve one or more outstanding issues through mediation. However, even resolving one item during mediation leaves less uncertainty in court.
Do I Still Need an Attorney with Mediation?
Having an attorney is not necessary in the mediation process, but it is still advisable to have your own attorney represent you. Having your own attorney to advise you during the entire process and help you understand the impact of your decisions is very important.
